Elon Musk files counterclaim against Twitter in a legal battle
Tesla CEO Elon Musk filed a counter-lawsuit against Twitter’s case for requiring him to complete the $44 billion acquisition of the company, court papers show.
It was a Delaware judge who said on Friday that a trial would begin on October 17 and last five days to hear the social media platform’s case against the richest person in the world.
JB Heaton, an asset investigator and retired attorney for the company told The Post that Musk’s anti-suit was likely filed under seal because it had information Twitter shared with Musk under a nondisclosure agreement or other restrictions.
Heaton stated it was almost certain that they included the facts they got under the expectation of confidentiality from Twitter.
Twitter needs to force Elon Musk to go ahead with its deal to buy the site for $44 billion.
Delaware District Court Judge Kathleen McCormick will likely have the groups agree on a partially edited performance that could be released to the public within a week, according to Heaton.
The Wall Street Journal mentioned Musk’s countersuit has a connection to a well-known quote from Warren Buffett, “Only when the tide goes out do you discover who has been swimming naked.”
